By accessing or using Devinue, you agree to these Terms of Service. If you use Devinue on behalf of an organization, you represent that you have authority to bind that organization.
2. Eligibility
Users must provide accurate registration information and maintain it over time. Accounts for users under 13 require verifiable parental or guardian consent.
3. Parent or Guardian Consent
For child accounts, the parent or legal guardian confirms they are authorized to consent to the child's participation and related data processing under these Terms and the Privacy Policy.
4. Account Security
Users are responsible for maintaining the confidentiality of account credentials and for activity that occurs under their account. Unauthorized use must be reported promptly.
5. Institutional Use
Educational institutions using Devinue remain responsible for classroom policies, student conduct decisions, and legally required notices or permissions.
6. Acceptable Use
Users may not:
- Attempt unauthorized access to Devinue systems
- Interfere with platform operations
- Upload malicious code or exploits
- Use the platform in violation of applicable law
- Harass or abuse other users
7. User Content
Users retain ownership of their submitted content. Users grant Devinue a limited, non-exclusive license to host, process, transmit, and display content solely to operate, secure, and improve the service.
Teachers and authorized institutional staff may access student submissions as part of normal classroom functionality.
8. AI Features
AI-generated outputs may be incomplete or inaccurate. Users remain responsible for reviewing outputs and for educational, grading, and instructional decisions.
9. Fees and Billing
Paid plans and add-ons are billed according to the selected subscription terms. Pricing or feature limits may change with notice where required by law.
10. Suspension and Termination
Educational institutions manage student conduct and disciplinary actions for institution-managed accounts.
Devinue may suspend or terminate accounts only for platform security risks, legal requirements, fraud, abuse of the service, or non-payment.
11. Disclaimers
Devinue is provided on an "as-is" and "as-available" basis. To the fullest extent permitted by law, Devinue disclaims warranties of merchantability, fitness for a particular purpose, and non-infringement.
12. Limitation of Liability
To the fullest extent permitted by law, Devinue and its affiliates are not liable for indirect, incidental, special, consequential, or punitive damages.
Total liability is limited to the amount paid for the service in the 12 months preceding the claim.
13. Additional Agreements
Institutional or enterprise customers may be subject to additional written agreements, including data processing agreements or security terms. If a conflict exists, the written agreement controls.
14. Changes
Devinue may update these Terms periodically. Material changes will be communicated through the platform or other reasonable channels.
15. Governing Law
These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles.
